President William Ruto commends the Supreme Court for its unwavering role in upholding Kenya’s Constitution, commending its influence in guiding lower courts and its steadfast protection of citizens’ rights.
Speaking at the Supreme Court buildings in Nairobi during the 12th anniversary of the Court’s establishment, Ruto praised its consistent handling of complex constitutional cases, which has strengthened Kenyans’ confidence in due process and legal safeguards.
“The Court has truly acted as a loyal custodian of our Constitution, a protector of fundamental rights, and a cornerstone of democracy,” Ruto said.
Recent controversies
Despite recent controversies surrounding some of the Court’s rulings, including last week’s decision upholding the contentious Finance Act 2023, Ruto highlighted the importance of the judiciary’s role.
The Supreme Court’s recent ruling overturned a prior Court of Appeal decision that nullified the Act due to insufficient public consultation.
Law Society of Kenya (LSK) President Faith Odhiambo and former LSK president Nelson Havi publicly criticized the ruling, arguing that public interest and legitimate expectations should not be overshadowed by legislative expedience.

Acknowledging the critique, Ruto urged a balanced view of the Supreme Court’s work.
“It would be unduly pessimistic to ignore the Court’s clear efforts to interpret the Constitution wisely, reinforcing democracy, justice, and the rule of law,” he stated.
The President noted growing cooperation among Kenya’s governmental branches, emphasizing the Supreme Court’s leading role in delivering justice and his commitment to supporting its work.
“We must unite with a shared purpose to ensure the Supreme Court remains a beacon of integrity, a guardian of rights and freedoms, a champion of the rule of law, and a force for progressive jurisprudence in Africa and globally,” Ruto concluded.
