High Court Approves Kindiki’s Swearing-In as Deputy President

The High Court in Nairobi has lifted prior orders that had prevented the swearing-in of Prof. Kithure Kindiki as Deputy President following Rigathi Gachagua’s impeachment.

The original orders were issued by the Kerugoya High Court on October 18, 2024, after a petition from David Munyi Mathenge and Peter Gichobi Kamotho, who argued that the case was of “significant national importance and urgency.”

However, a ruling from a three-judge bench consisting of Justices Antony Mrima, Eric Ogola, and Freda Mugambi in Nairobi on Thursday has now cleared the way for Kindiki’s swearing-in.

The judges ruled that the case will be revisited on November 7, 2024, and noted that Gachagua is free to appeal the decision.

“The applications for conservatory orders are hereby denied. The conservatory orders issued by the Kerugoya High Court on October 18, 2024, are discharged and set aside. Leave for appeal is granted. Typed proceedings and certified copies of this ruling will be available to parties at cost. The matter will be mentioned on November 7, 2024, at 2 p.m. in open court,” stated the ruling, read by Justice Ogola.

Earlier, Gachagua faced another setback when the Court of Appeal declined his request to prevent the High Court from proceeding with his impeachment case.

He had approached the appellate court, expressing dissatisfaction with the recent ruling by a three-judge bench that upheld Deputy Chief Justice (DCJ) Philomena Mwilu’s decision to establish the bench.
